General Rental Conditions - Winter Rentals - R&B Homes
Applicability
These conditions apply to all bookings and rental agreements mediated by R&B Homes on behalf of private property owners of holiday homes in Orihuela Costa. The tenant enters into an agreement with the property owner; R&B Homes acts solely as an intermediary.
R&B Homes mediates between private property owners and tenants of holiday homes. The rental agreement is always concluded between the tenant and the property owner. Where these terms refer to R&B Homes in relation to payments, cancellations, or security deposits, this is done on behalf of and under the instruction of the owner.
1. Reservations
- Reservations are only accepted from persons aged 21 or older.
- After booking, the tenant will receive a confirmation by email, including these terms and conditions and information regarding the security deposit.
- The rental agreement is established between the owner and tenant once R&B Homes confirms the reservation.
- If no confirmation is received within 10 days, the tenant must contact R&B Homes. Without confirmation, the reservation expires.
2. Payment
- A reservation is valid upon payment of the stated security deposit.
- The full rental amount must be paid to the owner no later than one month before arrival. Payment details will be provided no later than two months before arrival.
- Payment of the deposit implies acceptance of the rental terms and conditions.
- If payment is not received on time, R&B Homes reserves the right to cancel the reservation.
- Final cleaning fee of € 110,- is to be paid upon arrival.
- Administration fee of € 35,- is also payable upon arrival.
3. Security Deposit
- The deposit serves as security for damages, loss, or breach of obligations.After departure, the deposit will be refunded within 14 days, after deduction of any costs.R&B Homes will handle this on behalf of the owner and will provide a statement of reasons if (part of) the deposit is withheld.
- If the deposit is insufficient, additional compensation may be claimed.
- Excessive energy consumption beyond the included limit will be deducted from the deposit.
- To refund the deposit, R&B Homes must have the tenant's IBAN number (not always automatically stated on bank statements in Spain).
4. Cancellation
- Cancellations must be made in writing by email.
- The deposit is non-refundable in case of cancellation.
- If cancelled within 30 days before arrival, the full rental amount is due.
- Inthe event of cancellation by R&B Homes on behalf of the owner, any amounts already paid will be refunded.
5. Arrival & Key Handover
- Arrival is possible Monday to Saturday between 3:00 p.m. and 8:00 p.m.
- Arrival on Sundays, public holidays, or after 8:00 p.m. (latest 10:00 p.m.) is possible at a surcharge of € 40,-.
- Keys are handed over at the R&B Homes office.
- Keys may not be duplicated. Violation results in a € 500,- fine.
- Loss or damage of keys will incur a charge of € 100,-.
- Locked out: € 25,- charge (deducted from the deposit).
- If a locksmith must be called (e.g. keys left inside the door), the cost is the tenant’s responsibility and must be paid in cash. This may be claimed from travel insurance.
6. Stay & Use of the Property
- The property may be occupied from 3:00 p.m. on the arrival date and must be vacated by 10:00 a.m. on the departure date.
- Permanent residency is not permitted; only holiday stays.
- Occupancy by more persons than agreed is not allowed without written permission.
- The property is non-smoking (smoking only allowed outside).
- No open flames or excessive noise permitted.
- Pets are only allowed if mentioned in advance; surcharge € 50,- per stay.
- No changes may be made to the property or inventory without permission.
- Furniture and inventory may not be moved or used outside (except dishes/cutlery).
- Water/gas/electricity are included up to € 150,- per month. Excess will be deducted from the deposit.
- Internet/wifi is not guaranteed; outages do not entitle to compensation.
- Commercial use of the property is prohibited.
- The tenant must report any defects, failures, or damage as soon as possible to R&B Homes.
- Visitors/guests are allowed, provided it does not exceed the permitted number or cause nuisance.
- Use of amenities (e.g., pool, air conditioning) is at the tenant's own risk and not guaranteed.
- In case of serious violation of the house rules or repeated nuisance, the rental agreement can be terminated immediately on behalf of the owner without refund. A fine can be imposed.
- Charging electric vehicles using the property’s electricity is prohibited. The supply is not equipped for this and may pose a fire risk.
- The tenant must ensure that any awnings are retracted and the house properly locked when leaving. It is recommended to close shutters, louver doors, and—if present—security gates.
7. Maintenance & Damage
- Necessary maintenance may be carried out during the stay.
- Damage or breakage must be reported immediately.
- The tenant is responsible for damage caused by improper use of toilets or equipment.
- R&B Homes is not liable for equipment failure, power failure, burglary or other unexpected technical or external circumstances beyond its control. The owner is responsible for the condition of the home. R&B Homes only mediates in complaints and is not liable for technical defects.
8. Departure & Cleaning
Upon departure, the tenant must:
- Leave the house clean and tidy (broom clean). Improper use or condition may incur additional (cleaning) charges.
- Return all inventory to its original place as indicated in the photo inventory book.
- Wash, dry, and store dishes properly.
- Place duvets/blankets neatly on the beds. If laundry is left behind, R&B Homes will collect and wash it at the tenant's expense (deducted from the deposit).
- Empty and clean the dishwasher and refrigerator.
- Remove all food items from cupboards/fridge/freezer.
- Store all garden furniture cushions indoors.
- Empty all bins.
- Report any damage or breakage.
9. Identification & Legal
- R&B Homes accepts no liability for theft, loss, or damage to property or persons during or as a result of the stay.
- Routine maintenance and repairs are the responsibility of the property owner. The tenant must notify R&B Homes of any defects and follow instructions.
- R&B Homes is not liable for roadworks, construction, or disruption in the area, nor for outages in utilities, internet, or television.
- All identity details must be submitted prior to arrival, in compliance with Spanish rental laws.
- Failure to provide data on time may result in cancellation without refund.
- Spanish law applies.
- The tenant is responsible for valid travel documents, liability and cancellation insurance.
- Personal data is processed exclusively for booking purposes and in accordance with GDPR/Spanish data law (LOPD).
10. Force Majeure
- R&B Homes is not liable in cases of force majeure (e.g., pandemic, war, natural disasters). This does not affect statutory rights under European consumer law.
11. Complaints
- Complaints during the stay must be reported immediately so they can be resolved if possible.
- Complaints must be submitted in writing and with justification within 14 days after departure.
If any situation is not covered in these terms, R&B Homes will act reasonably in consultation with the owner and tenant.
